Pro novelu zákona o státním zastupitelství budou ve Sněmovně podle ministra spravedlnosti Pavla Blažka (ODS) hlasovat nejen poslanci vládní pětikoalice. O dlouhá léta diskutované změně, kterou chce vláda Spolu a PirSTAN prosadit ještě v letošním roce, jednal se zástupci opozičních hnutí ANO a SPD. Pro zavedení funkčního období státních zástupců a další změny bude podle Blažka „komplexní Sněmovna“. Uvedl to v dnešním pořadu Partie televize Prima CNN.
Funkční období státních zástupců plánuje Blažek stanovit na sedm let. „Uvažujeme jako u soudců, nevím jak u vrchního státního zástupce, to ať rozhodne Sněmovna,“ uvedl.
Podle exministryně vlády hnutí ANO a ČSSD Marie Benešové není úplně podstatné, jak dlouhé bude funkční období, novela by hlavně měla dát jasná pravidla pro odvolání státních zástupců. Shodla se na tom s Blažkem, podle kterého není možné, aby státní zástupci měli „své jisté na dvacet let“. Možnost odvolání podle něj má dát kárné řízení s jasnými pravidly. Benešová očekává nesouhlas státních zástupců s tím, kdo má být ve výběrové komisi pro stanovení vedoucích státních zástupců, jako tomu bylo v minulých pokusech o prosazení změny. Ministr, který nese odpovědnost, by podle Benešové měl mít vliv na to, kdo bude do vedení státních zastupitelství jmenován. Očekává v této věci bitvu.
Novela zákona o státním zastupitelství má zavést funkční období vedoucích státních zástupců, pravidla pro jejich transparentní výběr i podmínky jejich odvolání, včetně zpřesnění podmínek pro odvolání nejvyššího státního zástupce.
Blažek s Benešovou v pořadu práci některých státních zástupců kritizovali. Blažek poukázal hlavně na úniky z přípravných řízení do médií, v některých případech řízené, a to z Vrchního státního zastupitelství v Olomouci. Podle Benešové má stejný problém i Praha. Blažek chce nad státními zástupci nastavit supervizi tak, „aby všichni plnili, co je v zákonech“. Měli by mít podle něj i odvahu přes informace v médiích některá řízení nezahajovat, pokud k tomu nejsou důkazy.
V souvislosti s kauzou nákupu armádních letounů CASA, kdy stíhání bývalé ministryně obrany Vlasty Parkanové (KDU-ČSL, TOP 09) i jejího podřízeného Jiřího Staňka definitivně končí až po deseti letech, uvedl, že se někdy v řízeních nehledí na člověka. Je trápen deset let kvůli tomu, abychom věděli, jak máme postupovat, uvedl. Blažek v tomto případu chystá omluvu. Přál by si, aby se raději omluvili a nesli odpovědnost ti, kteří stíhali a soudili.
Případ, ve kterém byli Parkanová a bývalý šéf ministerské sekce vyzbrojování Staněk obviněni ze zneužití pravomoci veřejného činitele a porušení povinnosti při správě cizího majetku, se týká nákupu transportních letounů CASA C-295 pro české vojenské letectvo. Bývalá politička a její podřízený podle pravomocně zamítnuté obžaloby měli státu způsobit škodu 818,8 milionu korun (později byla částka snížena na 777 milionů). Nejvyšší státní zástupce Igor Stříž před týdnem rozhodl nepodat dovolání v této kauze, stíhání Parkanové i Staňka tak definitivně skončilo. Parkanová i Staněk mohou po státu žádat odškodné za nezákonné stíhání. Parkanová ČTK bez dalších podrobností řekla, že vedle odškodného se bude domáhat omluvy.
