POKYN OBECNÉ POVAHY nejvyššího státního zástupce ze dne 28. března 2017, o výkonu dohledu v soustavě státního zastupitelství („pokyn obecné povahy o dohledu“)
Podle § 12 odst. 1 zákona č. 283/1993 Sb., o státním zastupitelství, ve znění
pozdějších předpisů (dále jen „zákon“), stanovím:
ČÁST PRVNÍ
Obecná ustanovení
Čl. 1
Předmět úpravy
Tento pokyn obecné povahy upravuje podrobnosti postupu státních zastupitelství,
státních zástupců a vedoucích státních zástupců a jimi pověřených státních zástupců
při výkonu dohledu.1
Čl. 2
Základní ustanovení
(1) Účelem dohledu je přispět k zákonnému, odbornému, rychlému, účinnému a jednotnému výkonu působnosti státního zastupitelství.2
(2) Nejde-li současně o výkon dohledu, nelze do postupu ve věci zasahovat prostřednictvím práva vyžadovat informace, které státní zastupitelství potřebují k plnění svých úkolů.3 Vyžadování informací ve věci není výkonem dohledu.
(3) Nejblíže vyšší státní zastupitelství informuje nejblíže nižší státní zastupitelství o tom, k jakým závěrům při výkonu dohledu dospělo, a jaká opatření byla učiněna.
(4) Vedoucí státní zástupce nebo jím pověřený státní zástupce informuje státního zástupce, nad jehož postupem vykonal dohled, o jeho výsledku a o přijatých opatřeních.
(5) Nasvědčují-li poznatky získané při výkonu dohledu, že rozdílný nebo nesprávný výklad právních předpisů uplatňovaný jednotlivými státními zástupci nebo státními zastupitelstvími vyžaduje sjednocení nebo usměrnění, upozorní vedoucí státní zástupce nebo vyšší státní zastupitelství vykonávající dohled na tuto skutečnost Nejvyšší státní zastupitelství a současně uvede, z jakých důvodů pokládá za vhodné situaci řešit vydáním pokynu obecné povahy, popř. jeho změnou, nebo vydáním stanoviska ke sjednocení výkladu zákonů a jiných právních předpisů při výkonu působnosti státního zastupitelství.
Čl. 3
Výkon dohledu
(1) Dohled se vykonává z vlastní iniciativy, pokynu nejblíže vyššího státního zastupitelství (čl. 6 odst. 2) nebo na základě jiných poznatků, zejména podnětu k výkonu dohledu (čl. 10 odst. 1).
(2) Dohled může být vykonán i na základě podnětu vyššího státního zastupitelství, které nad postupem nižšího státního zastupitelství nevykonává dohled.
Čl. 4
Instanční a vnitřní dohled
(1) Pro účely tohoto pokynu obecné povahy se instančním dohledem rozumí dohled podle § 12d zákona a vnitřním dohledem dohled vykonávaný vedoucím státním zástupcem nebo jím pověřeným státním zástupcem podle § 12e zákona. 4
(2) Výkon vnitřního dohledu nesmí nahrazovat výkon instančního dohledu.
(3) Výkon instančního dohledu je možný i nad vnitřním dohledem.
(4) Součástí výkonu vnitřního dohledu může být i postup při výkonu instančního dohledu.
(5) Nařídí-li vedoucí státní zástupce nebo jím pověřený státní zástupce výkon vnitřního dohledu, určí zároveň státního zástupce, kterého pověřuje výkonem vnitřního dohledu, pokud jej neprovede sám.5
(6) Výkonem vnitřního dohledu nemůže být pověřen státní zástupce, který v rámci aprobace schválil úkon nebo jiné opatření nebo vydal pokyn k takovému úkonu či jinému opatření, jež mají být předmětem vnitřního dohledu.
Čl. 5
Pokyny a stanoviska
(1) Vyžaduje-li to povaha a závažnost nedostatků zjištěných při výkonu dohledu v konkrétních věcech, vydá nejblíže nižšímu státnímu zastupitelství nejblíže vyšší státní zastupitelství písemný pokyn.6
(2) V písemném pokynu nejblíže vyšší státní zastupitelství uvede
a) výslovné označení, že se jedná o pokyn, popřípadě výslovné označení, že se jedná o pokyn k výkonu dohledu,
b) věc, jíž se týká,
c) jednoznačné stanovisko k postupu nebo vyřízení věci nebo k výkonu dohledu,
d) lhůtu pro splnění pokynu,
e) odůvodnění pokynu.
(3) Má-li státní zastupitelství za to, že pokyn nejblíže vyššího státního zastupitelství nesplňuje všechny náležitosti pokynu, neprodleně tento svůj názor s uvedením důvodů písemně sdělí státnímu zastupitelství, které pokyn vydalo.
(4) Pokynem nelze nejblíže nižšímu státnímu zastupitelství uložit, aby samo reagovalo pokynem na nedostatky zjištěné u státního zastupitelství, nad jehož postupem vykonává
dohled.
(5) Pokud povaha a závažnost zjištěných nedostatků nevyžaduje vydání pokynu (odstavec 1), může nejblíže vyšší státní zastupitelství reagovat na nedostatky zjištěné při výkonu dohledu zaujetím stanoviska, které má pouze doporučující povahu a musí být náležitě odůvodněno.
(6) Přiměřeně podle odstavce 1 postupuje vedoucí státní zástupce nebo jím pověřený státní zástupce při výkonu vnitřního dohledu. Na žádost státního zástupce stvrdí ústně daný pokyn písemně.7
Čl. 6
Pokyny vydávané při výkonu dohledu nad dohledem a k výkonu dohledu
(1) Pokyn lze za podmínek uvedených v čl. 5 odst. 1 vydat i při výkonu dohledu nad činností státního zastupitelství, která je dohledem.8
(2) Nejblíže vyšší státní zastupitelství vydá pokyn k výkonu dohledu nejblíže nižšímu
státnímu zastupitelství ve svém obvodu zejména
a) pokud byly v konkrétní věci nebo ve více takových věcech některého státního zastupitelství, vůči němuž uvedenému nejblíže nižšímu státnímu zastupitelství přísluší výkon dohledu, získány poznatky o postupu, jenž není v souladu s právními předpisy nebo pokyny obecné povahy nejvyššího státního zástupce, a opatření ke zjednání nápravy dosud nebyla přijata, nebo
b) odůvodňují-li to poznatky o stavu zákonnosti v jednotlivých oblastech, v nichž státní zastupitelství je povinno vykonávat působnost.
Čl. 7
Obecné ustanovení k odmítnutí splnit pokyn
Nejblíže nižší státní zastupitelství může odmítnout splnění pokynu, má-li za to, že je v konkrétní věci takový pokyn nezákonný.9 Nejblíže nižší státní zastupitelství je povinno odmítnutí splnění pokynu náležitě odůvodnit a uvést, v čem spatřuje rozpor se zákonem, včetně odkazu na konkrétní ustanovení.
Čl. 8
Postup při odmítnutí splnění pokynu
(1) Zastává-li státní zástupce, jemuž je věc přidělena, názor, že pokyn nejblíže vyššího státního zastupitelství je v rozporu se zákonem, předloží odmítnutí splnění pokynu vedoucímu státnímu zástupci nebo jím pověřenému státnímu zástupci; jinak pokyn splní.
(2) Vedoucí státní zástupce nebo jím pověřený státní zástupce ve věci předložené mu státním zástupcem podle odstavce 1 vykoná vnitřní dohled podle § 12e zákona.
(3) Věc nelze přidělit jinému státnímu zástupci jen za účelem změny stanoviska k pokynu nejblíže vyššího státního zastupitelství.
Čl. 9
Postup po doručení odmítnutí splnit pokyn u nejblíže vyššího státního zastupitelství
(1) Nejblíže vyšší státní zastupitelství po doručení odmítnutí splnění pokynu přezkoumá pokyn a netrvá-li na jeho splnění, věc neprodleně vrátí nejblíže nižšímu státnímu zastupitelství; své stanovisko o tom, že na splnění pokynu netrvá, odůvodní.
(2) Pokud nejblíže vyšší státní zastupitelství na splnění pokynu trvá a neuplatní jiný postup, věc nižšímu státnímu zastupitelství usnesením odejme a vyřídí ji samo.
(3) Nejblíže vyšší státní zastupitelství může věc odejmout nejblíže nižšímu státnímu zastupitelství i bez předchozího odmítnutí splnění pokynu, je-li nejblíže nižší státní zastupitelství nečinné, nebo se v jeho postupu vyskytují nedůvodné průtahy.10
(4) O nečinnost nebo nedůvodné průtahy v postupu nejblíže nižšího státního zastupitelství půjde s přihlédnutím k povaze konkrétní věci zejména tehdy, jestliže v konkrétní věci neprovede úkon, který bylo povinno v souladu s platnými právními předpisy ve lhůtách zde uvedených provést, nebo nesplní pokyn vydaný nejblíže vyšším státním zastupitelstvím, pokud současně nevyužije možnosti odmítnout splnění pokynu pro rozpor se zákonem, anebo splnění odmítne při podstatném překročení lhůt uvedených v čl. 12 odst. 1.
ČÁST DRUHÁ
Výkon dohledu v trestních věcech
Vyřizování podnětů k výkonu dohledu
Čl. 10
(1) Podnětem k výkonu dohledu se rozumí podání vyslovující nespokojenost s postupem státního zastupitelství nebo státního zástupce v konkrétní věci, nejde-li o řádný opravný prostředek nebo podnět k využití mimořádných opravných prostředků, žádost o přezkoumání postupu policejního orgánu11 nebo státního zástupce,12 návrh na vyloučení státního zástupce z vykonávání úkonů přípravného řízení, nebo jiný podnět k postupu podle trestního řádu, popřípadě o stížnost na chování nebo na průtahy při plnění úkolů státního zastupitelství.13
(2) Podání lze posoudit jako podnět k výkonu vnitřního dohledu, jen vyplývá-li to zcela zjevně z jeho obsahu; jinak se posoudí zásadně jako podnět k výkonu instančního dohledu, jde-li o takový podnět. Vyřízení podnětu k vnitřnímu dohledu se nejblíže vyššímu státnímu zastupitelství vždy zašle na vědomí.
(3) Je-li státnímu zastupitelství doručeno podání, které lze posoudit jako podnět k výkonu instančního dohledu, a toto státní zastupitelství je k výkonu dohledu příslušné, nelze odmítnout výkon dohledu jen proto, že věc již byla dříve státním zástupcem tohoto nebo nejblíže nižšího státního zastupitelství přezkoumána z podnětu stížnosti podané proti usnesení policejního orgánu, např. o zahájení trestního stíhání nebo o odložení věci, nebo stížnosti podané proti usnesení státního zástupce nejblíže nižšího státního zastupitelství, a to popřípadě i opakovaně.
(4) Je-li podnět k výkonu instančního dohledu doručen tomu nejblíže nižšímu státnímu zastupitelství, jehož postup je v podnětu namítán jako nezákonný nebo nesprávný, nejblíže nižší státní zastupitelství bezodkladně předloží podnět i se spisovými materiály nejblíže vyššímu státnímu zastupitelství; od předložení spisových materiálů lze upustit tehdy, jestliže nejblíže vyšší státní zastupitelství rozhodne, že spisové materiály nejsou třeba (odstavec 7).
(5) Vedoucí státní zástupce nebo jím pověřený státní zástupce a nejblíže vyšší státní zastupitelství (dále jen „státní zástupce nebo státní zastupitelství vykonávající dohled“) nejsou při výkonu dohledu vázáni jen obsahem podnětu k výkonu dohledu.
(6) Státní zástupce nebo státní zastupitelství vykonávající dohled si mohou s přihlédnutím k povaze námitek uvedených v podnětu k výkonu dohledu vyžádat vyjádření dozorového státního zástupce nebo nejblíže nižšího státního zastupitelství.
(7) Konkrétní způsob výkonu dohledu jinak záleží na povaze přezkoumávané věci. Spisový materiál není třeba, pokud státní zástupce nebo státní zastupitelství vykonávající dohled mají v daném okamžiku dostatek podkladů pro přezkoumání postupu státního zástupce nebo nejblíže nižšího státního zastupitelství, zejména pokud byl ve věci vykonán dohled před velmi krátkou dobou, věc byla přezkoumána z jiných důvodů, např. při rozhodování o stížnosti, nebo tehdy, je-li po přezkoumání podnět k výkonu dohledu shledán zjevně nedůvodným
(8) Ze spisového materiálu o vykonaném dohledu musí být zřejmé, čeho se podnět k výkonu dohledu týká, vlastní zjištění, právní závěry a případný návrh opatření, jakož i údaj o tom, z jakých důvodů bylo upuštěno od vyžádání spisového materiálu. Pokud se tyto skutečnosti neuvedou do vyrozumění adresovaného podateli, zmíní se v záznamu, který se založí do dohledového nebo dozorového spisu.
(9) Podatele je třeba o výsledku přezkoumání věci bez spisového materiálu i se spisem vyrozumět ve lhůtě 2 měsíců; tuto lhůtu lze prodloužit, to neplatí, jde-li o přezkoumání věci bez spisového materiálu.
Čl. 11
(1) Nejblíže vyšší státní zastupitelství při vyřízení prvního podnětu k výkonu dohledu vždy podatele poučí podle § 1 odst. 4 jednacího řádu.
(2) Je-li státnímu zastupitelství doručen podnět k výkonu dohledu, jehož obsahem jsou námitky vůči již vykonanému dohledu, státní zástupce vyššího státního zastupitelství postoupí
podnět tomu nižšímu státnímu zastupitelství, jehož nesprávný nebo nezákonný postup při výkonu dohledu je v opakovaném podnětu namítán, k vyhodnocení, zda se nejedná o další obsahově shodný podnět podaný po poučení podle § 1 odst. 4 jednacího řádu.14
(3) Skutečnost, zda se jedná o opakovaný podnět, posuzuje a rozhoduje vždy státní zastupitelství, které ve věci vykonalo dohled; tomuto státnímu zastupitelství musí státní zastupitelství, jehož státní zástupce ve věci vykonává dozor, takový podnět předložit k vyhodnocení podle odstavce 2.
(4) O postoupení podnětu podatele státní zástupce vyššího státního zastupitelství
vyrozumí s výslovným upozorněním na možné odložení podnětu nejblíže nižším státním
zastupitelstvím bez dalšího vyrozumívání.15
(5) Nejblíže nižší státní zastupitelství obsahově shodný podnět odloží bez vyrozumění podatele.15 Dospěje-li po vyhodnocení obsahu podnětu k závěru, že jsou v něm uvedeny nové
skutečnosti, vykoná ve věci dohled, čl. 10 odst. 3 až 9 se použijí obdobně.16
(6) Nejblíže vyšší státní zastupitelství může i tehdy, bylo-li postupováno podle odstavců 2 až 5, v odůvodněných případech přezkoumat postup nejblíže nižšího státního zastupitelství při výkonu dohledu.17
Čl. 12
Odmítnutí splnění pokynu v trestní věci
(1) Odmítnutí splnění pokynu státní zástupce nejblíže nižšího státního zastupitelství
předloží nejblíže vyššímu státnímu zastupitelství písemně ve lhůtě 14 dnů od doručení pokynu, pokud vyšší státní zastupitelství ve svém pokynu nestanovilo lhůtu jinou, která však musí být přiměřená povaze a závažnosti věci. Lhůtu 14 dnů lze překročit jen výjimečně, a to nejvýše o dalších 14 dnů, zejména tehdy byla-li věc přidělena jinému státnímu zástupci, nebo jde-li o věc mimořádně skutkově nebo právně složitou; o tom je povinno nejblíže nižší státní zastupitelství neprodleně informovat nejblíže vyšší státní zastupitelství, které pokyn vydalo, včetně údaje o předpokládaném překročení lhůty. Jestliže je však splnění pokynu vázáno zákonnou lhůtou (např. podání opravného prostředku), odmítnutí pokynu nejblíže nižší státní zastupitelství předloží nejpozději dva pracovní dny před dnem, na který připadá konec zákonné lhůty. Týká-li se odmítnutí splnění pokynu zajištění osob a věcí podle hlavy čtvrté trestního řádu nebo operativně pátracích prostředků, státní zástupce nejblíže nižšího státního zastupitelství je předloží bezodkladně.
(2) Pokud nejblíže vyšší státní zastupitelství odejme věc nižšímu státnímu zastupitelství v důsledku odmítnutí splnění pokynu,18 nebo v případech uvedených v čl. 9 odst. 3 a 4, učiní tak usnesením, proti němuž není stížnost přípustná.19 Usnesení doručí státnímu zastupitelství, jemuž byla věc odňata, a policejnímu orgánu s pokynem, aby je založil do trestního spisu, jakož i obviněnému a jeho obhájci, poškozenému a jeho zmocněnci.20
(3) Odejme-li nejblíže vyšší státní zastupitelství věc za podmínek uvedených v odstavci 2 nejblíže nižšímu státnímu zastupitelství a vyřizuje ji nadále samo, může rozhodnout v přípravném řízení o skončení věci. Státní zástupce nejblíže vyššího státního zastupitelství je oprávněn podat u věcně a místně příslušného soudu obžalobu,21 návrh na schválení dohody o vině a trestu22 i návrh na potrestání23 a účastnit se řízení před soudem prvního i druhého stupně.
ČÁST TŘETÍ
Výkon dohledu v jiných než trestních věcech
Čl. 13
Při výkonu dohledu v jiných než trestních věcech se podle ustanovení části druhé
tohoto pokynu obecné povahy postupuje přiměřeně.
Čl. 14
Zrušovací ustanovení
Čl. 6 pokynu obecné povahy č. 8/2009, o trestním řízení, se zrušuje.
Čl. 15
Účinnost
Tento pokyn obecné povahy nabývá účinnosti dnem 1. května 2017.
