Plénum Ústavního soudu (soudce zpravodaj Pavel Šámal) částečně vyhovělo návrhu Okresního soudu v Chrudimi a zrušilo část ustanovení § 289 zákona č. 40/2009 Sb., trestního zákoníku, které zmocňovalo vládu k přijetí nařízení a stanovení, jaké konkrétní množství se považuje za větší než malé v případě omamných a psychotropních látek, přípravků je obsahujících a jedů. Současně Ústavní soud rozhodl, že pozbývají platnosti § 2 a příloha č. 2 nařízení vlády č. 455/2009 Sb., kterým se pro účely trestního zákoníku stanoví, které rostliny a houby se považují za rostliny a houby obsahující omamnou nebo psychotropní látku a jaké je jejich množství větší než malé ve smyslu trestního zákoníku, ve znění nařízení vlády č. 3/2012 Sb. V obou případech zrušil právní úpravu dnem vyhlášení nálezu ve Sbírce zákonů. Návrh na zrušení § 284 odst. 1 ve slovech „větším než malém“ a § 285 odst. 1 a 3 ve slovech “větším než malém“ a „ve větším rozsahu“ byl zamítnut, neboť Ústavní soud neshledal jejich neústavnost.
Okresní soud v Chrudimi (navrhovatel) podal návrh na zrušení předmětných ustanovení v souvislosti s dvěma obžalobami z přečinů týkajících se konopí setého, které bylo v jednom případě drženo (přečin přechovávání omamné a psychotropní látky a jedu podle § 284 odst. 1 trestního zákoníku) a ve druhém pěstováno (přečin nedovoleného pěstování rostlin obsahujících omamnou nebo psychotropní látku podle § 285 odst. 1 a 3 trestního zákoníku), za což mají být obžalovaní trestně postiženi, ačkoliv zákon ve spojení s judikaturou dopředu nestanovuje meze trestnosti s nutnou mírou určitosti, což podle názoru navrhovatele odporuje ústavnímu pořádku; odkazuje přitom na nález Ústavního soudu ze dne 26. 5. 2020, sp. zn. Pl. ÚS 46/18 (tisková zpráva a text nálezu jsou dostupné zde: https://bit.ly/32Yf4Fn).
Konkrétně namítá, že adresát trestněprávní normy musí mít dopředu alespoň v hrubých rysech představu, že dopustí-li se toho kterého jednání, půjde o jednání trestné. Těmto požadavkům však napadená ustanovení nedokáží dostát, protože trestněprávní praxe zjišťuje znaky trestnosti složitou expertízou (zejména stanovení množství THC), jejích výsledky adresát nemůže předvídat.
Ústavní soud konstatuje, že pojmy, které právo používá, by nepochybně měly být z hlediska právní jistoty jasné a jednoznačně formulované, současně však musí být dostatečně abstraktní, aby byly schopny zachytit co nejširší okruhy možných eventualit, které se v životě vyskytují nebo se v budoucnu mohou vyskytnout. Jeví-li se navrhovateli jako nedostatečné, že naplnění relativně neurčitého znaku typově popisujícího trestné jednání je určováno až na základě odborného zjišťování (expertízy), k tomu Ústavní soud uvádí, že jde o běžný postup, který je aplikován nejen v případech posuzování naplnění uvedených pojmů ve shora uvedené judikatuře, ale i v obdobných případech u dalších skutkových podstat trestných činů. Podobně se postupuje například při určení stavu vylučujícího způsobilost navozeného požitím návykové látky (např. alkoholu) u trestného činu ohrožení pod vlivem návykové látky podle § 274 trestního zákoníku.
Proto Ústavní soud považuje užití neurčitých právních pojmů v případech, kdy je úmyslem zákonodárce omezit rozsah kriminalizace určitého jednání nebo opomenutí, resp. stanovit dolní kvantitativní hranici trestnosti, za ústavně konformní, a proto neshledal navrhovatelem tvrzený rozpor s ústavním pořádkem. Ovšem i nadále bude úlohou obecných soudů (zejména Nejvyššího soudu) náležitě interpretovat dané neurčité právní pojmy a rozptýlit tak případné přetrvávající pochybnosti při jejich výkladu.
Navrhovatel rovněž namítal protiústavnost § 289 odst. 3 trestního zákoníku s odůvodněním, že zmocnění v něm zakotvené svou povahou odpovídá zmocnění obsaženému v původním znění § 289 odst. 2 trestního zákoníku, které Ústavní soud zrušil nálezem ze dne 23. 7. 2013, sp. zn. Pl. ÚS 13/12 (tisková zpráva a text nálezu jsou dostupné zde: https://bit.ly/3eGtcIB 
).
Problémem je, že stejně jako ve výše zmíněném nálezu, to, v jakém právním předpisu má být množství rostlin a hub obsahujících omamnou nebo psychotropní látku uvedeno, resp. úlohou Ústavního soudu je posoudit, zda vláda může dané množství rostlin nebo hub svým nařízením stanovit či nikoliv.
Ústavní soud dospěl ve shodě s nálezem sp. zn. Pl. ÚS 13/12 k závěru, že vláda nemůže svým nařízením stanovit, jaké je množství větší než malé. Vymezení, které jednání je trestným činem, je totiž podle čl. 39 Listiny základních práv a svobod svěřeno pouze zákonu, k jehož vydání je kompetentní pouze Parlament České republiky. Považoval-li zákonodárce za podstatné přesně definovat, jaké je pro účely právní kvalifikace skutkových podstat trestných činů množství větší než malé u psychotropních látek, mohl tak podle Ústavního soudu učinit toliko formou zákona.
Po nabytí vykonatelnosti nálezu sp. zn. Pl. ÚS 13/12 se jako řešení jeví určování množství rostlin a hub obsahujících omamnou nebo psychotropní látku cestou judikatury obecných soudů, což se podle Ústavního soudu v praxi osvědčilo. K vymezení pojmu „množství větší než malé“ v § 284 a § 285 trestního zákoníku již existuje rozsáhlá a ustálená judikatura obecných soudů, na základě které je možno učinit ústavně konformní výklad uvedeného pojmu. Navíc lze předpokládat, že Nejvyšší soud bude i nyní postupovat obdobným způsobem jako po nálezu sp. zn. Pl. ÚS 13/12, kdy vydal za účelem sjednocení dosavadní judikatury v dané oblasti stanovisko sp. zn. Tpjn 301/2013.
Účinky nálezu se odvíjí teprve ode dne, kdy bude nález vyhlášen ve Sbírce zákonů. Nosné důvody nálezu lze proto uplatnit pouze do budoucna, nikoli pro rozhodování soudu o skutcích, k nimž došlo za trvání napadené právní úpravy. Opačný přístup k zahájeným, ale i již ukončeným věcem, by totiž nevedl pro adresáty zrušeného ustanovení v rozporu se smyslem tohoto nálezu k vyšší míře právní jistoty.
