Za vážné zranění malého chlapce psem poslal soud Jaroslava Pasteliaka na deset měsíců do vězení. Kříženec tzv. bojových plemen loni na pražském Petříně prokousl dítěti hrudník a způsobil mu tříštivé zlomeniny žeber. Pasteliak, který psa venčil, k dnešnímu jednání bez omluvy nepřišel. Dříve uváděl, že pes není jeho, a vinu odmítal. Jeho obhájkyně argumentovala tím, že si chlapce měla lépe hlídat matka. Verdikt není pravomocný.
Obvodní soud pro Prahu 1 shledal muže vinným z nedbalostního těžkého ublížení na zdraví. “Pes nebyl na vodítku ani neměl košík. Kdyby tuto ochranu měl, zcela jistě by nedošlo k tomu, k čemu došlo,” konstatovala soudkyně Pavla Hájková. Podle svědků navíc Pasteliak nedělal první minutu či dvě nic pro to, aby zvíře od dítěte odtrhl. Součástí trestu je pětiletý zákaz držení či chovu zvířat, čímž soud zcela vyhověl návrhu státní zástupkyně. Muž má navíc uhradit zraněnému chlapci 508.000 korun, dalších 317.000 korun musí vyplatit zdravotní pojišťovně.
Pasteliak venčil psa Thora, kterého vlastní jeho známá, loni 1. dubna u horního stanoviště petřínské lanovky. Matka napadeného hocha u soudu vypověděla, že její čtyřletý syn si zvířete nevšímal a hrál si na zemi s listím. Kříženec plemen pitbulteriér a american bully se však dítěti znenadání zakousl do boku. Pokousal ho i na hlavě, částečně ho skalpoval.
Záchranáře přivolali kolemjdoucí. Osmapadesátiletý muž utekl i se psem a policii se přihlásil až po zveřejnění kamerových záznamů z místa incidentu. Soudkyně uvedla, že dítě bylo v přímém ohrožení života a že ho zachránil urgentní chirurgický zákrok. Podle jeho matky mu zůstalo 16 jizev.
“Tvrzení obžalovaného, že měl psa celou dobu na vodítku a těsně před útokem se mu vytrhl, protože se rozbila karabina, je zcela nevěrohodné,” podotkla Hájková. Upozornila jednak na záběry z kamer, podle nichž Pasteliak při útěku vedl psa na vodítku, jednak na výpověď jiného pejskaře, který Thora v parku už dříve opakovaně vídal na volno. Tento svědek navíc řekl, že Thor mu zranil psa dva týdny před útokem na dítě.
U soudu svědčil i cvičitel Thora, který uvedl, že zvíře nebylo a stále není agresivní a že bez problémů reaguje na povely. Útok označil za zkrat. Nejúčinnějším řešením, jak podobným případům zabránit, by podle něj bylo, kdyby pes nosil košík. Pasteliak výcvik mladého psa přerušil v době koronavirové pandemie. Cvičitel zmínil i to, že muž ho odpoledne po incidentu žádal, jestli by mu Thora pár dní nepohlídal. O napadení mu neřekl, ačkoliv věděl, že cvičitel má rovněž doma malé dítě.
Státní zástupkyně původně pro muže žádala podmínku. Kvůli jeho přístupu k celé věci ale návrh změnila na nepodmíněné odnětí svobody. Obhájkyně Denisa Soukup Hrušáková prohlásila, že u jejího klienta zcela chybí zavinění. Uváděla také, že muž kvůli celé záležitosti bere antidepresiva. Požadovala ho zprostit obžaloby z toho důvodu, že se vůbec neprokázalo, že se daný skutek stal. „Matka evidentně zanedbala dohled nad poškozeným. Stála od něj příliš daleko a odvedla ho do oblasti, kde je povoleno volné pobíhání psů,“ prohlásila. Proti tomu se však státní zástupkyně i soudkyně ohradily, podle nich to není pravda.
Soudkyně ostře zkritizovala jak přístup obžalovaného, tak i způsob, jakým ho jeho advokátka hájila. “Jsem úplně konsternována z toho, jakou závěrečnou řeč tady paní obhájkyně prezentovala za svého klienta. Očekávala jsem, že pan obžalovaný projeví aspoň trošku sebereflexe, lítosti. Čekala jsem všechno možné, ale tohle teda bylo opravdu něco,“ řekla. „Dodneška nezaplatil poškozeným ani korunu,“ zdůraznila. Jedinou formou omluvy byl podle soudkyně dopis v češtině zaslaný chlapcově matce, o které Pasteliak věděl, že nerozumí česky. Připomněla také, že hoch si ponese tělesné i psychické doživotní následky a že se nyní bojí chodit kamkoliv, kde by se mohl potkat se psem.
