Brno 28. května (ČTK) – Ústavní soud (ÚS) odmítl stížnost muže, jenž se podle svých slov stal v první polovině 90. let obětí zneužívání a vydírání dvěma kněžími římskokatolické církve. Trestní oznámení podané v roce 2019 policie odložila. Oba kněží už dříve zemřeli. Oznámení mířilo také na současného kardinála Dominika Duku, kterému se muž před lety svěřil. Podle policie se Duka nedopustil trestného činu nadržování, neprokázalo se, že by kněžím pomáhal uniknout odpovědnosti. ÚS rozhodoval neveřejně. Anonymizované usnesení zpřístupnil ve své databázi.
Poté, co policie trestní oznámení odložila, obracel se muž také na státní zastupitelství. Žalobci nepochybovali o tom, že se muž skutečně stal obětí sexuálních útoků. Konstatovali však, že trestní právo nemá prostředky, jak útoky nyní potrestat.
V ústavní stížnosti se muž dovolával práva na účinné vyšetřování. Orgány činné v trestním řízení se prý oznámením nezabývaly dostatečně komplexně, jejich přístup nesl rysy amatérismu nebo zaujatosti. „ÚS nesdílí názor stěžovatele, že by prověřování bylo vedeno neúplně, respektive že by docházelo k úmyslné dezinterpretaci prováděných důkazů,“ reagovali ústavní soudci.
Soud není podle usnesení oprávněn hodnotit morální aspekty Dukova jednání poté, co se dozvěděl o „sexuálně závadovém jednání“ jednoho z kněží. „Rozhodné je, že v rovině právní není možno D. D. za tento konkrétní skutek trestně stíhat,“ stojí v usnesení.
Pisatel ústavní stížnosti se podle svých slov stával obětí sexuálních ataků v letech 1991 až 1994, kdy mu bylo 16 až 19 let. Přišel do Prahy studovat, bydlel v kostelnickém bytě při jednom z pražských chrámů, kde vykonávali duchovní správu dominikáni. Zneužívání se na něm prý dopouštěl jednak jeho zpovědník, jednak další kněz, který mu prý také vyhrožoval, že pokud něco oznámí, bude „vyhozen“ a nebude moci hrát na varhany.
Nakonec se mladík za podpory jednoho ze svých učitelů rozhodl promluvit a vyhledal tehdejšího provinciála řádu Dominika Duku. Oznámil mu zneužívání jedním knězem, protože druhý v mezičase odešel na Slovensko. Duka tehdy obě strany konfrontoval a údajně uvedl, že jde o tvrzení proti tvrzení. Mladíkovi prý řekl, že se může obrátit na policii a na světícího biskupa, ale že by měl přivést alespoň dva svědky, aby jeho tvrzení nabylo věrohodnosti. Zneužívání pak podle tvrzení oběti ustalo. Že se případem zabýval a že šlo o patovou situaci, potvrdil zpětně i Duka.
Ze záznamů poskytnutých Českou dominikánskou provincií vyplynulo, že proti jednomu z kněží později na Slovensku připravovali kanonický proces pro podezření ze zneužívání dětí, nicméně kněz před jeho zahájením zemřel. Proti druhému z kněží byla shromážděna svědectví o tom, že se dopouštěl – obvykle v podnapilém stavu – zneužívání, respektive obtěžování dětí a mladých dospělých. V roce 2005 byl suspendován.
Muž v ústavní stížnosti také napsal, že podle informací, které má k dispozici, věděl Duka i o dalších kněžích, dopouštějících se zneužívání. Prý proti tomu nic nedělal, dokonce aktivně bránil vyšetření. „Takové závažné obvinění, které stěžovatel nyní vznáší, by však stěžovatel musel uplatnit v samostatném podání orgánům činným v trestním řízení, jež by pak muselo být řádně prověřeno s ohledem na vázanost těchto orgánů zásadami oficiality a legality,“ uvedl ÚS.
