Osvobození bývalého předsedy Věcí veřejných Víta Bárty a někdejšího zpravodajce Jana Petržílka v kauze vynesení odposlechů z Bezpečnostní informační služby (BIS) je pravomocné. Dnes to potvrdil pražský vrchní soud, který zamítl odvolání státního zástupce. V medializovaných odposleších se tehdejší pražský primátor Pavel Bém (ODS) a lobbista Roman Janoušek oslovovali „Mazánku“ a „Kolibříku“.
Nahrávky, které v březnu 2012 zveřejnila Mladá fronta Dnes, naznačovaly Janouškův vliv na kroky hlavního města pod Bémovým vedením. Obžaloba tvrdila, že o obstarání nahrávek požádal Bárta zpravodajce BIS Petržílka v roce 2009. Petržílek Bártovi podle státního zástupce následně předal 159 audiozáznamů, které byly v režimu „důvěrné“. Muži vinu odmítali.
Podle státního zástupce mohl Bárta informace získané z odposlechů využít v rámci svých podnikatelských aktivit a také pro činnost Věcí veřejných. U městského soudu loni obžaloba pro oba muže žádala podmíněné tresty za ohrožení utajované informace. Soud ale tehdy zpochybnil věrohodnost klíčového utajeného svědka z prostředí Bártovy bezpečnostní agentury ABL, který vystupoval pod smyšleným jménem Vlasta Schmidt. Ke stejnému závěru nyní dospěl i odvolací senát.
Bárta byl od roku 2010 ministrem dopravy i poslancem. Post ministra opustil v dubnu 2011 kvůli tvrzení, že poslancům své strany platil za loajalitu. Soudy jej i v této věci pravomocně zprostily viny. Nyní Bárta podniká v železniční dopravě.
Petržílek vedl po odchodu z BIS analytický odbor protikorupční policie, kvůli stíhání je nyní mimo službu. Už dříve avizoval, že od státu bude chtít za stíhání odškodné v řádu milionů korun. Ústavní soud mu dal nedávno za pravdu v tom, že kauzu provázely průtahy.
Dvojice čelila stíhání od roku 2013. Městský soud v minulosti vrátil obžalobu k došetření, protože mu vadilo to, že byla v utajeném režimu. Následně se snažil stíhání zastavit s tím, že obžaloba se opírá v podstatě výhradně o výpovědi anonymních svědků.
