Evropský výbor pro sociální práva dnes zveřejnil rozhodnutí se závěrem, že tuzemská právní úprava neskýtá dětem mladším 15 let dostatek procesních práv v řízeních o činu jinak trestném. K tomuto závěru Výbor dospěl na základě kolektivní stížnosti organizace International Commission of Jurists, které dal částečně zapravdu v tom, že by děti měly mít nárok na právní pomoc advokáta od samého počátku řízení. Zákon by jim také měl dávat alternativy k soudnímu projednání jejich protiprávního jednání.
Ačkoliv již nyní při prvních úkonech v řízení dítě obvykle doprovází zákonný zástupce a pověřený pracovník orgánu sociálně-právní ochrany dětí, nemohou podle Výboru nahradit právní pomoc poskytovanou advokátem. Ta je přitom v řízení důležitá pro prevenci sebeobviňování dětí i jako pojistka před špatným zacházením.
Za další nedostatek předprocesní fáze řízení s dětmi do 15 let Výbor označil nedostupnost alternativ neboli odklonů k formálnímu soudnímu řízení. Výbor připomněl, že je obecně škodlivé děti vystavovat systému soudnictví. Naopak odklony, které zabraňují stigmatizaci a patří mezi nástroje tak zvané restorativní justice, mají dobré výsledky z hlediska úsilí o nápravu dítěte i vynaložených nákladů.
Výbor ve svém rozhodnutí ze dne 20. října 2020 dále zdůraznil, že nutná obhajoba od samého počátku řízení i odklony jsou zárukami, které dle české právní úpravy nejsou dostupné trestně neodpovědným dětem. Mladiství (tedy starší děti) je k dispozici mají. Pro nižší míru ochrany dětí mladších 15 let a jejich podpory v řízení o činu jinak trestném přitom neexistují pádné důvody. Výbor tak uzavřel, že Česká republika dětem nezaručuje patřičnou sociální ochranu, která jim přísluší podle článku 17 Evropské sociální charty.
Česká republika se řešením problémů, které jí Výbor vytkl, dlouhodobě zabývá. Problém od roku 2016 řeší Kolegium expertů k výkonu rozsudků Evropského soudu pro lidská práva, které iniciovalo vytvoření zvláštní pracovní skupiny. V minulosti se tématu věnoval i Výbor pro práva dítěte Rady vlády pro lidská práva. V reakci na rozhodnutí Evropského výboru pro sociální práva budou obnoveny diskuze o potřebné změně právní úpravy.
