Nejvyšší státní zastupitelství SL 902/2007
POKYN OBECNÉ POVAHY
nejvyšší státní zástupkyně ze dne 25. května 2007, o databázi „Událost“
Podle § 12 odst. 1 zákona č. 283/1993 Sb., o státním zastupitelství, ve znění pozdějších předpisů, stanovím:
Čl. 1
Základní ustanovení
(1) Tento pokyn obecné povahy je závazný pro všechny zaměstnance státního zastupitelství.
(2) Policejní databázi „Událost“ spravuje pro potřeby státního zastupitelství Nejvyšší státní zastupitelství (dále jen „správce“). Uživatelé získávají data dálkovým připojením k datové síti Ministerstva spravedlnosti.
(3) Uživateli jsou vedoucí státní zástupci, jejich náměstci, ředitelé odborů s výjimkou ředitelů správy, ředitelé sekretariátů a bezpečnostní ředitelé. Vedoucí státní zástupce může určit uživateli další státní zástupce, u okresního státního zastupitelství i vedoucího správy. Zánik práva uživatele pro přístup do databáze oznámí neprodleně vedoucí státní zástupce správci.
(4) Správce
a) zajišťuje provoz databáze a hlásí závady v činnosti, vede evidenci uživatelů,
b) na základě žádosti, která obsahuje
1. označení státního zastupitelství a spisovou značku,
2. jméno, příjmení, funkci žadatele, jeho čísla telefonu a e-mailovou adresu, 3. datum a podpisy uživatele a vedoucího státního zástupce, zřizuje a ruší účty, přiděluje přístupová práva, uživatelská jména a hesla jednotlivým uživatelům a sděluje jim je způsobem zaručujícím důvěrnost,
c) je oprávněn kontrolovat rozsah přidělovaných přístupových práv k databázi.
(5) Po technické stránce odpovídají určení informatici za provoz databáze u správce a za funkčnost dálkového přístupu k databázi u ostatních státních zastupitelství.
Čl. 2
Ochrana dat
(1) Přístup do databáze lze uskutečnit jen pro povolené zjišťování nezbytných údajů. Za oprávněnost nakládání s údaji odpovídá uživatel, který připojení uskutečnil.
(2) Při využívání databáze musí být zabezpečeny údaje uložené v počítači pomocí ochrany přístupu k těmto údajům heslem a identifikací uživatele. Uživatel se musí při každém připojení k databázi identifikovat přístupovým jménem a heslem. Hesla s nejméně 10 znaky musí obsahovat malá a velká písmena, číslice a nealfanumerické znaky. Stejné znaky se mohou vyskytovat nejvýše ve dvou dvojicích.
(3) Nesmí se používat jiné než povolené připojení a sdělovat uživatelské jméno a heslo neoprávněným osobám. Porušení ochrany hesla uživatel nebo vedoucí státní zástupce ihned ohlásí správci, který po ověření ukončí platnost hesla.
(4) Za zajištění ochrany dat odpovídá vedoucí státní zástupce. Veškeré přístupy k databázi musí být ukládány do archivního souboru. Správce zajišťuje pravidelné zálohování výpisů přístupů k databázi, které se uchovávají nejméně 3 roky.
(5) Ochrana dat platí obdobně pro nakládání s údaji zjištěnými z databáze, jestliže je nutno při plnění služebního úkolu seznámit s těmito údaji další osoby.
Čl. 3
Zrušovací ustanovení
Zrušuje se pokyn obecné povahy nejvyššího státního zástupce č. 3/2006, o užívání policejní databáze „Událost“.
Čl. 4
Účinnost
Tento pokyn obecné povahy nabývá účinnosti dne 1. července 2007.
