Státní zástupce Jaroslav Šaroch navrhuje v obžalobě týkající se případu dotace na stavbu areálu Čapí hnízdo pro bývalého premiéra Andreje Babiše (ANO) podmínku a peněžitý trest deset milionů korun, uvedl dnes server Seznam Zprávy. Pro jeho někdejší poradkyni Janu Nagyovou navrhl stejný podmíněný trest a zaplatit by měla půl milionu korun. Oběma obžalovaným přitom hrozí až deset let vězení.
Šaroch podal obžalobu na Babiše a Nagyovou minulý týden. Případem se bude zabývat Městský soud v Praze. Bývalý premiér a šéf nyní opozičního ANO vinu dlouhodobě odmítá. Kauzu Čapí hnízdo pokládá za vykonstruovaný a účelový pokus o svou kriminalizaci a o snahu vystrnadit ho z politiky. U soudu chce prokázat, že nikdy nic trestného neudělal.
Žalobce podle serveru Seznam Zprávy navrhuje Babišovi i Mayerové tříletý trest podmíněně odložený na zkušební dobu pěti let. „Pro Babiše pak chce žalobce ještě peněžitý trest ve výši deset milionů korun a pro Mayerovou peněžitý trest ve výši 500 tisíc korun,“ napsal server s odkazem na dva zdroje z justice, které mají obžalobu k dispozici.
Mluvčí městského státního zastupitelství v Praze Aleš Cimbala se k Šarochovu návrhu nechtěl vyjadřovat. Uvedl jen, že návrh, který do obžaloby napsal, není konečný a může být odlišný od toho, který padne případně u soudu. „Závěrečný návrh pak bude odpovídat skutkovému stavu po provedeném dokazování před nalézacím soudem,“ sdělil Seznam Zprávám.
V kauze Čapí hnízdo bylo původně obviněno 11 lidí včetně členů Babišovy rodiny. Šaroch postupně zastavil stíhání všech obviněných. Bývalý nejvyšší státní zástupce Pavel Zeman však v prosinci 2019 po přezkumu obnovil stíhání Babiše a Nagyové. Zároveň potvrdil, že stíhání Babišových blízkých definitivně skončilo.
Policisté následně uzavřeli vyšetřování kauzy na konci loňského května, oba obviněné navrhli obžalovat. Šaroch na konci srpna rozhodl o tom, že jim případ vrátí k došetření. Učinil tak zejména proto, aby vyšetřovatelé doplnili výslechy svědků, mimo jiné Babišova syna Andreje Babiše mladšího.
Policisté znovu navrhli oba obviněné obžalovat 20. září, vyšetřování ale následně zdrželo to, že Babiš v říjnových volbách znovu nabyl poslanecký mandát, a tím i imunitu. Sněmovna Babiše ke stíhání vydala na začátku března.
Podstatou případu je podle dřívějších informací to, že Čapí hnízdo původně patřilo Babišovu holdingu Agrofert. V prosinci 2007 se však přeměnilo na akciovou společnost s akciemi na majitele a později získalo padesátimilionovou evropskou dotaci v programu pro malé a střední podniky, na kterou by jako součást Agrofertu nemělo nárok. Akcie údajně vlastnily Babišovy děti a partnerka. Společnost se po několika letech pod Agrofert vrátila. V roce 2017 Babiš vložil holding do svých svěřenských fondů.
